The defendant was stopped for speeding. Officers noticed an odor of alcohol, bloodshot/watery eyes, and he used his door for support upon exiting the car. He stumbled while walking, swayed while he stood, and had slightly slurred speech. After performing the HGN (eye test), walk and turn, and one leg stand exercises, he was arrested for DUI. He later blew a .138 and .135 in the breath machine.

The defendant was stopped for speeding. Officers observed an odor of alcohol, bloodshot eyes, a sway to his stance, and his overall balance was poor. He was requested to perform the field sobriety tests, which consisted of the HGN (eye test), one leg stand, finger to nose, and the walk and turn. The defendant was arrested for DIU and later blew a .106 and .103 in the breath machine.

The defendant was stopped for swerving over the painted lane dividers several times. Officers noticed an odor of alcohol, mumbled speech, watery eyes, a dazed/blank expression, and she was unsteady on her feet. She performed poorly on the field sobriety tests which consisted of the HGN (eye test), walk and turn, and one leg stand. She was arrested for DUI and later blew a .092 and .091 in the breath machine.

Due to a .02 margin of error in the breath machine, the firm was able to place both her breath test results under the legal limit. After negotiations with the State regarding the evidence and the defendant, the State Dropped the DUI.

Oct 15, 2025 Case: 25-MM-014457 Judge Ingram
The defendant was the at fault driver in a rear end crash. Officers arrived on scene and noticed watery eyes, constricted pupils, had a hard time focusing, was sweating heavily, and his legs and arms were shaking uncontrollably. There was no odor of alcohol. Believing he was impaired by drugs, he was requested to perform the field sobriety tests, which consisted of the HGN (eye test), one leg stand, finger to nose, and the walk and turn. He was subsequently arrested for DUI and later refused a urine test. This was the defendant's Third DUI.
Under Florida law (Florida DUI statute 316.193), the State must prove that defendant was impaired by a specific controlled or chemical substance. One cannot just be impaired by anything like a bad avocado. Here, they could not prove by what specific substance was allegedly impairing him. Also, the officer who conducted the DUI was in training, being told what to do and reading off a sheet of paper. It was clear that the defendant was a Guinea Pig for her to learn how to do a DUI. The State Dropped the Third DUI.

The defendant was stopped for speeding and weaving. Officers noticed and odor of alcohol, slow/slurred speech, and lethargic movements. His eyes were also bloodshot and watery, and he was slow to exit the car. He performed poorly on the field sobriety tests which consisted of the HGN (eye test), walk and turn, and one leg stand. He was arrested for DUI and later blew a .128 and .124 in the breath machine.

The defendant was stopped for driving over the double yellow lines multiple times. Officers noticed an odor of alcohol, glassy eyes, and slurred speech. He performed poorly on the field sobriety tests which consisted of the HGN (eye test), one leg stand, finger to nose, alphabet, and walk and turn. He was arrested for DUI and later blew a .155 and .149 in the breath machine.

The defendant was stopped for speeding and swerving all over the road. Officers noticed an odor of alcohol, slurred speech, bloodshot eyes, and he stated that he had consumed one beer. After performing the HGN (eye test), walk and turn, and one leg stand exercises, he was arrested for DUI. He later blew a .111 and .108 in the breath machine.

The defendant was found passed out in his car in the middle of an intersection. Upon awakening him, officers noticed an odor of alcohol, slurred speech, and he was unbalanced. His clothes were disheveled and zipper down. He performed poorly on the HGN (eye test), walk and turn, alphabet, finger to nose, and one leg stand exercises. He was arrested for DUI and later refused a breath test.

Oct 9, 2025 Case: 25-CT-010616 Judge Gutman
The defendant was stopped for being passed out in a lane of travel on the interstate highway. Upon awakening him, officers observed an odor of alcohol, bloodshot eyes, slurred speech, and he admitted to doing three to four shots of tequila. He performed very poorly on the field sobriety tests which consisted of the HGN (eye test), walk and turn, and one leg stand. He was arrested for DUI and later blew a .181 and .168 in the breath machine.

Oct 8, 2025 Case: 25-CT-007569 Judge Gutman

The defendant was found sleeping in his car on the grass next to a fence at a boys and girls club. Once the officer got the defendant to wake up, they noticed an odor of alcohol, bloodshot/glassy eyes, and slurred speech. He also gave inconsistent answers to questions and made unusual statements. He refused to do any field sobriety tests and was arrested for DUI. He later refused a breath test. This was the defendant's Second DUI.

The officer wrote that he had to knock on the window numerous times to get the defendant to wake up. That was not true, because on tape, he did two quick knocks and the defendant immediately woke up. He then ordered him to roll down his window. The firm provided signs from the fence line to the State showing that the defendant was legally parked. The officer had no reasonable suspicion to order the defendant to roll his window down. The defendant immediately woke and he could have been innocently sleeping. Since all observations were made after that unlawful command, all the evidence would have been thrown out. The State agreed and DIsmissed his Second DUI.

Oct 8, 2025 Case: 25-CT-005324 Judge Eckley-Moulder
Police were called to a bar reference a disturbance that the defendant was causing while he was intoxicated. When police arrived, the defendant was driving down the street and he was ordered to stop. Officers observed an odor of alcohol, slurred/mumbled speech, and he denied drinking alcohol. The defendant agreed to perform only the HGN (eye test) and refused to do any other field sobriety tests. He was arrested for DUI and later reused a breath test.

The defendant was stopped for speeding, weaving, and driving on the opposite side of the road. Officers observed an odor of alcohol, bloodshot/glassy eyes, and slurred speech. After performing the HGN (eye test), one leg stand, and walk and turn exercises, he was arrested for DUI. He later refused a breath test. This was the defendant's Second DUI.

The defendant was stopped for speeding and weaving. Officers noticed an odor of alcohol, an open beer in plain view in the center console, and glassy eyes. He also had dilated pupils and slurred speech. He performed poorly on the field sobriety tests which included the HGN (eye test), walk and turn, and one leg stand. He was arrested for DUI and later refused a breath test.

Oct 8, 2025 Case: 24-CT-020900 Judge Allen
The defendant was stopped for drifting off the road, turning too wide, and driving on the wrong side of the road. Officers noticed an odor of alcohol, slurred/rambling speech, and bloodshot/glassy eyes. She refused to do any roadside tests and was arrested for DUl. She later refused a breath test.

Oct 7, 2025 Case: 24-163487MU10A Judge Levy

The defendant hit the side of the curb causing damage to her tires. Road patrol came on scene, made observations of the defendant and called 911. Road patrol told dispatch that the defendant did not look right and was possibly impaired. The officers arrived on scene and made observations consistent with impairment. Specifically, the defendant was extremely unsteady on video, almost falling over several times. In addition, the defendant admitted to taking a controlled substance prior to driving. She was arrested for DUI. She subsequently provided a urine sample which revealed the presence of Lorazepam.

The defendant explained on video that she was diagnosed with bronchitis. Parks & Braxton obtained the defendant's medical records which supported her claim that she was sick. In addition, bronchitis affects blood cell count which would explain the defendant's extreme unsteadiness on video. The firm subpoenaed the records custodian to admit the medical records in trial. After refusing to deviate for months, the State finally agreed to drop the DUI.

Oct 7, 2025 Case: 24-019540MU10A Judge Evans
The defendant was stopped for driving the wrong way towards oncoming traffic. The officers observed an odor of alcohol, bloodshot eyes, and slurred speech. The officers also observed beer cans in the vehicle. The defendant was asked to exit the car whereby the officer observed unsteadiness. The defendant originally refused to perform field sobriety tests, but agreed once the officers placed him in handcuffs. He performed the HGN (eye test), walk and turn, one leg stand, finger to nose exercises, as well as the modified Rhomberg (time estimation test). The video showed that on the walk and turn test the defendant failed to walk heel to toe and stumbled on the turn. On the one leg stand the defendant dropped his foot a few times. On the finger to nose the defendant used his pad rather than the tip of his finger when touching his nose. The defendant was arrested for DUI and refused to submit to a breath test.

Parks and Braxton announced ready for trial. While the defendant did not perform perfectly on the field sobriety exercises, it was clear that the officer both exaggerated and mischaracterized the defendant's performance. As far as the refusal to submit to a breath test, the defendant was already under arrest. He wasn't going to be let go if he provided a breath test regardless of the results. In addition, it seemed obvious from the video that the defendant was refusing a breath test not because he was trying to conceal the results, but rather because he did not trust the police. The state dropped the DUI just as the jury was coming in on the morning of trial.

The defendant was stopped for having an expired registration. Officers noticed an odor of alcohol, slurred speech, and glassy eyes. He was lethargic, swayed, had poor balance, staggered, and stumbled around. After performing the HGN (eye test), walk and turn, and one leg stand exercises, he was arrested for DUI. He later refused a breath test.

The defendant was found passed out in a lane of travel on an interstate highway. Upon awakening him, the officers observed an odor of alcohol, slurred speech, and watery eyes. The defendant was stopped for speeding. Officers noticed an odor of alcohol, fumbling fingers, glassy eyes, and unsteady balance. The defendant admitted to coming from a bar. After only performing the HGN (eye test), he refused to perform any other field sobriety tests and was arrested for DUI. He later refused a breath test.

Oct 1, 2025 Case: 25-CM-002824 Judge Gutman
The defendant was driving erratically and then was the at fault driver in a rear end crash. Officers noticed an odor of alcohol, bloodshot eyes, and slurred speech. His face was flushed and he appeared lethargic and sleepy. He refused to do any field sobriety tests and was arrested for DUI. He later refused a breath test.
Under Florida law, a breath test cannot be requested until after one is arrested for DUI. Here, the officer asked for a breath test prior to arresting him for DUI. Thus, the refusal to take the breath test would have been excluded from evidence. After negotiations with the State regarding the misinformation of law, the State Dropped the DUI.

Oct 1, 2025 Case: 25-CF-000461 Judge Hamilton
The defendant was stopped for weaving all over the road for a long distance and time. Officers noticed and odor of alcohol, he appeared unbalanced, and had slurred speech. His face was flushed, he had watery eyes, and he shuffled though his documents. He refused to do any roadside tests and was arrested for DUI. He later refused a breath test. Officers also found a controlled substance and he was charged with felony possession.

The defendant was stopped for swerving and being unable to maintain a single lane. Officers noticed an odor of alcohol, slurred speech, and watery/glassy eyes. The defendant admitted to consuming three glasses of wine. After performing the HGN (eye test), walk and turn, and one leg stand exercises, she was arrested for DUI. The defendant later blew a .188 and .179 in the breath machine.

The defendant was stopped for driving southbound in the northbound lane. Officers noticed an odor of alcohol, glossy eyes, and the defendant stated that he had consumed three to four beers, “but who's counting.” After performing the HGN (eye test), walk and turn, and one leg stand exercises, he was arrested for DUI. He later blew a .123 and .121 in the breath machine.

Sep 25, 2025 Case: AKWREWE Judge Mckyton

The defendant was stopped for driving the wrong way down a one-way street. Officers noticed an odor of alcohol, a dazed/blank expression, mumbled speech, bloodshot eyes, and he stumbled and almost fell. His movements were quick and clumsy, and he appeared unsteady. The defendant refused to perform any field sobriety tests and was arrested for DUI. He later refused a breath test.

On tape, the defendant's speech was not mumbled and he was not off balance nor unsteady. He never stumbled. He did not appear clumsy at all. After negotiations with the State regarding the video tape evidence and the defendant, the State Dropped the DUI.

The defendant was stopped for running a red light and nearly causing a collision. Officers noticed an odor of alcohol, glassy/watery eyes, slurred speech, and she admitted to having taken several medications. She also stated that the medications that she takes do not mix well with alcohol. Her movements were slow and sluggish and she appeared unsteady. Believing she was impaired by drugs, the defendant then performed the HGN (eye test), walk and turn, and one leg stand exercises. She was arrested for DUI and later refused a urine test. This was the defendant's Second DUI.

The defendant was stopped for weaving into the bicycle lane multiple times. Officers noticed an odor of alcohol, glassy eyes, and slurred speech. The defendant was stopped for speeding. Officers noticed an odor of alcohol, bloodshot eyes, and the officer noticed several beer cans in the car. The defendant appeared unsteady, stumbled, and he swayed while he stood. After performing the HGN (eye test), walk and turn, and one leg stand exercises, he was arrested for DUI. He later blew a .181 and .172 in the breath machine.

The defendant was the at fault driver in a side swipe crash. Officers observed an odor of alcohol, a flushed face, bloodshot eyes, unsteady balance, and slurred speech. The defendant refused to perform any field sobriety tests and was arrested for DUI. He later refused a breath test.
On tape, the defendant's speech was normal and not slurred. His balance was not unsteady and walked around and stood normally. In addition, he was totally responsive and coherent. After conversations with the State, they Dropped the DUI.

The defendant was stopped for driving with no lights after dark and weaving. Officers noticed an odor of alcohol, fumbling fingers, slurred speech, and watery/glassy eyes. After performing the HGN (eye test), one leg stand, and walk and turn exercises, she was arrested for DUI. She later blew a .183 and .175 in the breath machine.

Sep 22, 2025 Case: 25-CT-010932 Judge Gutman
The defendant was involved in a traffic crash. When officers arrived, they noticed an odor of alcohol, slurred speech, bloodshot/glassy eyes, and he admitted coming from a bar. He refused to do all field sobriety tests and was arrested for DUI. He later refused a breath test.
The defendant was not the at fault driver. Another driver ran a red light and plowed into the defendant and another person. On tape, his speech was totally normal, he had no balance issues, and he was responsive and coherent. Also, he had no sway and walked normally. He did not look or sound impaired at all on tape. He was the victim. After conversations with the State regarding the facts, the State Dismissed the DUI.

Sep 18, 2025 Case: 24-CT-059241 Judge Jacobus
Officers were called out regarding a reckless driver riding on his rims. The civilians who called the police were on scene as well. When officers arrived, they noticed the defendant's van with no tires (on its rims) in the left lane parked in a slanted manner. Officers went up to the defendant and noticed an odor of alcohol, slurred speech, and a flushed face. The defendant was very argumentative and belligerent. He refused to do any field sobriety tests and was arrested for DUI. He later refused a breath test. This was the defendant's Fourth DUI.
Parks & Braxton filed a motion to suppress the evidence based on an unlawful arrest. There was no traffic crash, and when officers arrived, the defendant was standing outside his van. Pursuant to Florida Statute 901.15, the arrest was unlawful due to the fact the misdemeanor (i.e., the first element of DUI: driving or actual physical control) did not occur in the officer's presence and there was no exception for a traffic crash. The fellow officer rule does not apply as the wheel witness was a civilian, and not a law enforcement officer. The State agreed that the arrest was unlawful and prior to any motion hearing being held, the State Dropped the defendant's Fourth DUI.

Sep 18, 2025 Case: 25-CT-023250 Judge Jacobus
Officers were called to the scene of a Hooters parking lot in reference to a suspicious vehicle driven by the defendant. The caller from Hooters stated that the defendant was causing a disturbance over a bill dispute and they had to stop serving the defendant alcohol because he was too drunk. Officers observed an odor of alcohol, glassy/watery eyes, and a flushed face. The defendant then performed the HGN (eye test), walk and turn, one leg stand, and finger to nose exercises. He was arrested for DUI and later refused a breath test. This was the defendant's Second DUI.
On tape, the defendant's speech was normal. He was not off balance or unsteady, and appeared very responsive and coherent. His walk and turn, finger to nose, and one leg stand were almost perfect. After conversations with the State regarding the evidence, they Dropped his Second DUI.

Sep 16, 2025 Case: 25-CT-028668 Judge T. Brown
A concerned citizen dialed 911 stating that the defendant was swerving and driving recklessly. Officers spotted the defendant and observed him weaving all over the road and fluctuating speeds. Officers observed an odor of alcohol, bloodshot eyes, and slow speech. His movements were lethargic and he used his car for balance. After performing the HGN (eye test), estimation of 30 seconds, finger to nose, and one leg stand exercises, he was arrested for DUI. He later refused a breath test.

Sep 15, 2025 Case: 25-CT-003263 Judge Legler

The defendant drove his motorcycle into oncoming traffic then crashed into a ditch. Officers noticed an odor of alcohol, bloodshot/watery eyes, and he had a bracelet on from a bar. He refused to do any field sobriety tests and was arrested for DUI. The defendant later refused a breath test.

When the officer arrived, he put cuffs on the defendant because the defendant tried to accelerate on his bike. The defendant was simply doing that to try to get the bike out of the ditch and didn't even see or hear the cop. We put forth that there was unlawful "arrest" prior to any DUI investigation, based on the unlawful handcuffing and placing the defendant into custody.

Sep 15, 2025 Case: 24-CF-014237 Judge Green
The defendant was stopped for speeding and straddling the yellow line. Officers noticed an odor of alcohol, slurred speech, and bloodshot eyes. While performing the HGN (eye test), the defendant kept moving her head and yelling. The defendant refused to do any other roadside tests and kept talking over the officer. While the defendant was being arrested for DUI, she tensed up and used her weight to resist being cuffed. She was cursing at the officers as well. Post arrest, the officers found cocaine in her bra. At the breath facility, she refused a breath test. The defendant was charged with DUI, Felony Possession cocaine. and resisting an officer without violence.

The defendant was stopped for speeding. Officers noticed an odor of alcohol, slurred speech, and red/bloodshot eyes. His movements were lethargic and he appeared unsteady. The defendant was stopped for an expired tag. Officers observed an odor of alcohol, slow/slurred speech, and lethargic actions. The defendant denied drinking any alcohol and also handed the cop a credit card instead of his license. The defendant refused to do any field sobriety tests and was arrested for DUI. He later refused a breath test.

An officer was finishing a service call in a parking garage and noticed the defendant's head pressed into the glass window and not moving. As the officer exited his patrol car and approached, the driver's door opened, and the defendant appeared to slump down even lower and almost fell from the driver's seat. He then began vomiting outside the driver's door. The officer noticed an odor of alcohol, heavily slurred speech, and trouble coherently organizing his thoughts. When asked if he had been drinking, the defendant stated "a bit too much. " The defendant performed poorly on the only field sobriety test which was the walk and turn. He was arrested for DUI and later blew a .178 and .177 in the breath machine.

The officer wrote in his report that as he approached the defendant, the drivers' door opened, he almost fell out, and the defendant began vomiting. However, on tape, when the officer pulled up and got out of car, you can see the defendant passed out. No door opened and he was not vomiting in front of the officer. The officers credibility was called into question. After conversations with the State regarding the contradictions between the reports and the video, the State Dropped the DUI.

The defendant was the at fault driver in a rear end crash whereby he was driving a semi-truck. Officers noticed an odor of alcohol and watery/glassy eyes. After performing the HGN (eye test), walk and turn, and one leg stand exercises, he was arrested for DUI. He later refused a breath test.
The trooper wrote a very vague and poorly written report, most likely assuming we can see all the specifics the field sobriety tests on his dash cam. However, the police department could not retrieve the footage. After the prosecutor tried several times and could not locate the video, they Dropped the DUI.

Even after being involved in a rollover crash, on tape, the defendant's speech was normal, he had no balance issues, was polite, and seemed responsive and coherent. The defendant was stopped for speeding and swerving in and out of his lane on three occasions. Aug 21, 2025 Case: AJ8ZRWE Judge Lawhorne
The defendant drove over a curb, struck a pedestrian crossing sign, and then struck a light pole. The car skidded in the grass and then turned upright. There was no odor of alcohol, but officers noticed droopy eyelids, swaying, unsteadiness, he was very uncooperative/combative. His speech was mumbled and incoherent, as well. EMS arrived and had to strap him down and sedate him. He was then taken to the hospital for treatment. The police charged him with DUI and he later provided a urine sample. The defendant's urine tested positive for midazolam ( a sedating drug used in hospitals) and also evidence of marijuana.
The defendant was definitely impaired and out of his mind on tape. However, the firm got the defendant's EMS records from the scene. They revealed that it was EMS that gave him the drug (midazolam), not as the State originally thought that the defendant used it to get drugged up. We also pointed out that the urinalysis for marijuana was not suitable for analysis and was flawed. The State agreed Dropped the DUI.

The defendant was found by police in his car parked sideways and across multiple parking spaces. When officers went up to talk to him, they noticed an odor of alcohol, slurred speech, and bloodshot eyes. He swayed and stumbled while standing outside the car. The defendant performed poorly on the walk and turn and one leg stand exercises. The defendant couldn't perform the HGN (eye test), because kept moving his head. He was arrested for DUI and later refused a breath test.

The defendant was stopped for running a flashing red light and almost hitting a cop. The officer pulled the defendant over and went up to his car. Right off the bat, the officer calls in "signal one" (code for DUI). The officer says he noticed a marijuana shaker on the floorboard. The officer observed the defendant to have red/glassy eyes, slow/raspy speech, lethargic movements, and there was no odor of alcohol. The defendant refused to perform any field sobriety tests and was arrested for DUI. He later refused a urine test.
The officer had no basis to call in signal one (code for DUI) as he hadn't even made any observations. It was obvious he was aggravated the defendant had almost cut him off. However, that was not true, because on tape, the defendant hadn't even come close to the officer when he ran the flashing red. In fact, the defendant realized he had went past it then stopped short. Also, there were no pictures taken nor any discussion of any marijuana shaker, if it even existed to begin with. The officer never asked the defendant one question such as: where are you coming from, have you taken drugs, gave you been drinking (Nothing). The firm sent a letter requesting a dismissal of the DUI and the State agreed and they Dismissed the DUI.

The defendant was stopped for swerving all over the roadway, failing to maintain a single lane, and driving in the emergency lane. There was no odor of alcohol, but officers noticed slurred speech, she was unable to formulate a sentence, and had a flushed face. Her eyes appeared slightly dilated, she stumbled, could not stand up straight, and she needed to lean on her car for balance. The defendant denied taking any drugs, but officers believed she was under the influence of drugs based on their observations. She performed poorly on roadside tests which consisted of the HGN (eye test), walk and turn, and one leg stand. She was arrested for DUI and later refused a breath and urine test. Officers found a pill bottle with D-Amphetamine salt combo upon a search incident to arrest.

On tape, the defendant seemed to have no idea what the officers were telling him or advising him as far as the instructions on the field sobriety tests. His first language is Creole, not English. Officers made no effort to try to find an officer who speaks Creole. After conversations with the State about what took place on tape, the State Dropped the DUI to a Civil Careless Driving infraction.

The defendant was stopped for speeding. Officers observed an odor of alcohol, bloodshot/glassy eyes, and droopy eyelids. He also seemed to appear sluggish, have an uneasy walk, and an orbital sway. The defendant denied consuming any alcohol. The defendant agreed to perform the HGN (eye test) and refused to perform any other field sobriety tests. He was arrested for DUI and later refused a breath test. This was the defendant's Third DUI arrest.
The firm announced ready for trial. On tape, the defendant had no sway, was not sluggish, and did not appear "uneasy." In fact, we put forth that to us, none of his normal faculties were impaired. After negotiations a couple of weeks prior to the trial date, the State Dropped the defendant's Third DUI.

On tape, the defendant had no understanding of the instructions on the field sobriety tests. His first language is Vietnamese and speaks very little English. In addition, he did not appear off balance or unsteady on tape, versus what was written in the police reports. The defendant was stopped for speeding. He was traveling 116 mph. Officers stopped him and noticed an odor of alcohol, bloodshot/watery eyes, and slow/slurred speech. The defendant stated he had drank beer. He then performed the HGN (eye test), walk and turn, one leg stand, and estimation of 30 seconds exercises. He was arrested for DUI and also reckless driving for his very excessive speed. After his arrest, he refused a breath test.
The firm had conversations with the State regarding the videotape that we received in discovery. On tape, the defendant did not appear to be impaired on any of his field sobriety tests. This was truly a case about excessive speeding, not DUI. The State agreed and Dismissed the DUI charge and we resolved the other charge of reckless driving.

We had a conversation with the prosecutor and pointed out that on tape, not one of the defendant's normal faculties were impaired. In addition, his movements were not slow or lethargic. Also, one deputy told the defendant on tape that he was being arrested for "drinking and driving." It is not a crime in Florida to drink and drive. What is a crime is to drive while your normal faculties are impaired. The State agreed and Dismissed the DUI.

The defendant was the at fault driver in a rear end crash. Officers observed an odor of alcohol, rapid speech, and dilated pupils. The defendant admitted to drinking one beer. Field sobriety tests are supposed be conducted in a dry area. In this case, he had the defendant perform them in the rain. Also, officers are supposed to demonstrate the roadside tests properly on tape and here they were demonstrating in a very confusing way. Finally, the State could not place the defendant in actual physical control of the car at the time of the crash. On the day of trial, the DUI was Dismissed.

All the airbags deployed during the crash in the defendant's vehicle. We pointed out to the State that any impairment, such as unsteady balance, bloodshot eyes, and slurred speech could have been equally attributed to being hit in the head and body with airbags versus alcohol. Police were called to a bar regarding an intoxicated male (i.e., the defendant). The defendant was causing a disturbance as he was allegedly threatening bar staff and telling them he was going to kick their asses. Officers located the defendant and conducted a traffic stop. They observed an odor of alcohol and mumbled speech. Due to the defendant a having various medical ailments, he performed nonphysical field sobriety tests such as the HGN (eye test), finger to nose, palm pat, and hand coordination. He was then arrested for DUI and later refused a breath test.
On tape, the officer had no idea how to instruct the defendant on the field sobriety tests. Her instructions were so confusing that no one could understand them. The defendant had to ask several clarifying questions over and over on tape. Even the prosecutor, after viewing the tape, agreed with our position. After a few conversations, the State Dropped the DUI and he received no criminal conviction.

The defendant was stopped for running a red light. Officers noticed an odor of alcohol, a flushed face, slurred speech, and he was unsteady. He also staggered and swayed. The defendant only performed the HGN (eye test) and then refused to perform all other field sobriety tests. He was arrested for DUI and later refused a breath test. This was the defendant's Second DUI.

On tape, the defendant was not unsteady, his speech was not slurred, and he never staggered or swayed. Also, the officer never gave any adverse consequences when the defendant refused roadside tests as required by law. Also, when a defendant refuses to perform field sobriety tests, an officer must advise them of the adverse consequences for refusing. For example, the officer must state something like, "I am going to have base my decision to arrest you on what I have observed so far if you refuse." In addition, the officer can state to the defendant that their refusal can be used against them in court. If they do not give any adverse consequences, the refusal will be excluded from evidence. Here, the officer did not give the defendant any adverse consequences. The State Dropped the defendant's Second DUI.

Parks & Braxton filed a motion to suppress all the evidence. In our motion, we alleged that the traffic stop was unlawful. Pursuant to Florida Statute 316.155(1) and Florida case law (i.e., State v Riley), a traffic stop can only be conducted for failure to use turn signal if other traffic is affected. Here, there was no traffic affected. Thus, the stop was unlawful and all the evidence subsequent to the stop would have been suppressed (excluded). The State agreed and Dismissed the DUI.

The defendant was on the river in his kayak which a had a trolling motor. The police stopped him because he had no registration. Officers noticed an odor of alcohol, unsteady balance, and bloodshot eyes. After performing various boating under the influence field sobriety tests such as the HGN (eye test), finger to nose, palm pat, and hand coordination, he was arrested for Boating Under the Influence and later blew a .137 and .134 in the breath machine.
Under the law, the kayak having a motor can be the basis for a BUI charge. However, after conversations with the State about the ridiculousness of being arrested for BUI on a kayak on a river with a trolling motor, that can only go about 2 mph, the State Dismissed the BUI.

The defendant crashed his car on the highway into a median wall. Officers arrived and noticed an odor of alcohol, watery eyes, and slurred speech. He also had trouble balancing. The defendant stated someone else was driving the car. The defendant refused to perform any field sobriety tests and was arrested for DUI. He later refused a breath test.

When officers arrived, the defendant was standing outside his car. He denied being the driver. Other officers from a different agency were on scene as well and the State could not provide their names. The State could not prove that the defendant was the driver based on a lack of evidence and Dropped the DUI.

The defendant was stopped for driving with no lights and crossing over the solid white line and right side of the roadway multiple times. There was no odor of alcohol, but officers noticed glassy eyes, slurred speech, a flushed face, and her movements were clumsy and slow. The defendant admitted to having taken several medications. She performed very poorly on roadside tests, such as the HGN (eye test), walk and turn, and one leg stand. She was arrested for DUI and later provided a urine sample. The sample was sent to the FDLE lab and came back positive for numerous illegal controlled substances.

After commands for the defendant to stand in a certain location, the officer grabbed the defendant's arm. He tensed up and was taken to the ground. He was charged with DUI and resisting an officer without violence. He later refused a breath test.
The police reports were highly exaggerated and made the defendant out to be falling down drunk. The video contradicted almost every observation written in the reports. Officers were the aggressors in the takedown, not the defendant. The State Dropped the DUI and Dismissed the resisting charge.
